Terms of Service
What Hummand offers, what it guarantees and what it does not guarantee outside a contract, and the responsibilities of those who use it. Courtesy translation. The Portuguese version at hummand.com.br is the binding one.
1. Acceptance
By accessing or using the products and services of Hummand Consultoria LTDA, you declare that you have read, understood and agreed to these Terms. If you do not agree, do not use the services.
2. The service
Hummand offers human identity infrastructure: acts with policy, sources and a humanproof/1 receipt, through the API, the dashboard and the journey by link. Features, usage limits and service levels, where they exist, are those defined in the contract between the parties. Outside a contract nothing is guaranteed, and every capability carries the label of its state: available, in accreditation or target architecture.
3. Account and credentials
You are responsible for the confidentiality of API keys, sessions and authentication factors, and for every activity performed with them. Notify Hummand immediately in case of unauthorized use; key rotation is available in the dashboard.
4. Acceptable use
Use of the services is subject to the Acceptable Use Policy, at hummand.com.br/en/politica-de-uso, which forms part of these Terms.
5. Personal data
In the services, Hummand is the processor and the client is the controller. The client is responsible for the legal basis and for the data subjects' consent, collected in the journey with Hummand's versioned text, and for the purpose of the acts it requests. Processing is described in the Privacy Policy (hummand.com.br/en/privacidade) and at hummand.com.br/en/lgpd.
6. The receipt
The humanproof/1 receipt is a signed record of what happened in an act, verifiable outside Hummand through the published public key. It is not an expert report, not an anti-fraud opinion, it estimates neither risk nor probability, and it does not replace the client's decision process.
7. Intellectual property
Software, documentation and content made available by Hummand are its property or licensed to it. Nothing in these Terms transfers to the user any intellectual property right over the services. Receipts issued for the client belong to the client.
8. Availability
Hummand makes reasonable efforts to keep the services available, but does not guarantee uninterrupted availability beyond what the contract defines. Scheduled maintenance is announced at least 48 hours in advance. The declared state of each component is at hummand.com.br/en/status.
9. Limitation of liability
To the maximum extent permitted by law, Hummand is not liable for indirect, incidental, special or consequential damages arising from the use or the inability to use the services. Hummand's total liability is limited to the amount paid for the services in the twelve months preceding the event.
10. Termination
Either party may terminate upon prior notice as set out in the contract. Hummand may suspend access immediately in case of violation of these Terms or of the Acceptable Use Policy. Receipts already issued remain verifiable through the public key.
11. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of João Pessoa, Paraíba, are elected to settle any dispute arising from them, waiving any other.
12. Updates
Hummand may update these Terms. Material changes are communicated thirty days in advance; continued use after they take effect constitutes acceptance. The version in force is at hummand.com.br/termos.
